What is Mediation?

Mediation is an efficient and inexpensive procedure for reaching agreements between a separating or divorcing couple, assisted by an impartial professional.
You will each receive the legal and financial and, if applicable, parenting information necessary to create a settlement best suited to your individual needs.
At the end of the mediation, you will receive a written document called the “Separation Agreement.” This is your actual Divorce Agreement, and you may file this document directly in court.

 

When should you use mediation?

You may see a mediator at any time before, during or after your separation or divorce. They will help you to resolve one issue or more of the following:

  • Assets and liabilities
  • Child custody and support
  • Parenting schedules
  • Medical insurance coverage
  • Property division
  • Tax consequences
  • Alimony

 

Is mediation appropriate for you?

Yes mediation has a proven success record for all couples.

Will I need a lawyer?

No, you will not need another lawyer. We may recommend you consult with a separate attorney. The mediator will write the legal Divorce Agreement. In Massachusetts, you do not need a lawyer to represent you in your divorce action. The mediator will provide you with step-by-step instructions in filing for a no-fault, uncontested divorce.

 

Are sessions confidential?

Yes, all mediation sessions are fully confidential, according to Massachusetts State Law, Chapter 233, Section 23c, which provides for the mediator/client legal privilege.

 

What costs are involved?

Your mediation costs will be based on a per hour charge. The total cost of your divorce will be substantially less than hiring separate lawyers. 

 

How long does it take?

On average, the mediation process takes three to five sessions, depending upon the complexity of each situation. Mediation is a voluntary process and may be ended at any time.
