MEDIATION CONTRACT

Separation and/or Divorce

 

We are requesting services from Diane Neumann & Associates: Divorce Mediation Services, under the following conditions:

 

1.      This mediation is voluntary.  Either of us may choose to end the mediation at any time.

 

2.      We will make all of the decisions; the mediator cannot impose any decision upon us.

 

3.      Mediation sessions are totally confidential.  We will not subpoena the mediator nor his/her files in any legal proceeding.

 

4.      We will each fully disclose and document all of our financial income, assets, and liabilities to each other and to the mediator during the mediation.  This documentation will be retained for twelve months and then destroyed.

 

5.      Either of us may seek professional and/or legal advice at any time during the mediation and we each consent to our mediator contacting, responding, and/or releasing information to our respective attorneys, financial and tax advisors, counselors, and other professionals regarding only that client.

 

7.      Each of us understands that the mediator is not acting as an attorney, financial advisor, or tax advisor, and is not representing either or both of us.  The mediator recommends that we each have a separate attorney review our Separation Agreement prior to signing the final document.

 

8.      At the conclusion of the sessions, the mediator will prepare a written Separation Agreement (which will be our divorce agreement), which sets forth the divorce settlement, and we will each receive a copy.
